In this action, the plaintiff appeals the district court’s order granting summary judgment in favor of the defendants on all counts. We affirm in part and reverse in part.

Audrey L. Burton was employed by Banta Global Turnkey, Ltd. (“Banta”) and covered by health insurance through MethodistCare, Inc. By acquisition and change of name, MethodistCare became UniCare Health Plans of Texas, Inc. (“UniCare”).
