William Fore, plaintiff-appellant, instituted in the District Court of the United States for the Eastern District of Virginia a civil action under the Federal Employers’ Liability Act, 45 U.S.C.A. §§ 51-59, hereinafter called the Act, against the Southern Railway Company, hereinafter called Southern, defendant-appellee. Southern, at the close of plaintiff's evidence and again at the close of all the evidence, moved the Court for a directed verdict in its favor.
