The defendant appeals from a judgment granting a peremptory writ of mandamus commanding him as justice of the peace in the city of Hutchinson to grant a change of the place of trial and transmit the papers to another justice of the peace in an action pending before the defendant, wherein the Hutchinson Lumber Company is plaintiff and John L. Weaver, the plaintiff in the present action, is defendant.
