This is an original application to this court for a writ of mandate to compel respondent to dismiss an action pending therein, instituted by the Potosí Land and Mining Company, a corporation, against a former administrator of the said estate of Alexander Hulsey, N. L. Peterson, James B. Lutman, the Shasta Dredging Co., a corporation, and certain fictitious defendants. The action was one by the plaintiff therein to quiet its alleged title to certain land in Shasta County.
