A general court-martial composed of officer and enlisted members convicted Appellant, contrary to his pleas, of rape (2 specifications), forcible sodomy, sodomy, assault and battery, and adultery (three specifications), in violation of Articles 120, 125, 128, and 134, Uniform Code of Military Justice [hereinafter UCMJ], 10 U.S.C. §§ 920, 925, 928, and 934 (2000). The members sentenced Appellant to a dishonorable discharge, confinement for ten years, total forfeitures, and reduction to Private (E-l). The convening authority disapproved the sodomy…
