This matter comes before the court on cross-motions for summary judgment. Plaintiff, Metro Machine Corp. (“Metro Machine”), seeks a declaration that the decision of defendants, United States Small Business Administration (“SBA”) and Michael P. McHale, Associate Administrator of the HUBZone Program, to de-certify Metro Machine as a qualified HUBZone small business concern was arbitrary, capricious, an abuse of discretion, or otherwise contrary to law, pursuant to 5 U.S.C. § 706(2)(A).
