This pre-award bid protest is before the court on cross-motions for judgment on the administrative record filed under Rule 52.1 of the Rules of the United States Court of Federal Claims (RCFC). In this ease, plaintiff Aeolus Systems, LLC (Aeolus) challenges the United States Small Business Administration’s (SBA) determination that Aeolus was not a qualified Historically Underutilized Business Zone (HUBZone) small business concern.
