This action is before the court on defendants’ and defendant-intervenor’s joint motion to dismiss the Amended and Supplemental Petition pursuant to Federal Rule of Civil Procedure 12(b)(6). Plaintiffs in this case are applicants for the Suffolk County Police Department who challenge a police officer examination developed and administered by Suffolk County (the “County”) in 1999, following the entry in 1986 of a Consent Decree in United States v.
