The Appellant 2 has been subpoenaed as a witness before the April 2002 Special Grand Jury (hereafter the “Special Grand Jury”) and has refused to answer any questions beyond his name, address and occupation. The government petitioned the district court to hold the Appellant in contempt and the Appellant moved to quash the subpoena. The district court granted the petition for contempt and effectively denied the motion to quash after the Appellant persisted in his refusal to comply with the subpoena following a grant of use immunity pursuant to 18 U.S.C. §§…
