Kevin Ellis (“Ellis”) brought a negligence action against Luxbury Hotels (“Luxbury”) seeking damages for personal injuries he sustained while he was visiting a guest at Luxbury. Ellis claimed, among other things, that Luxbury’s negligence caused his injuries.1 In his claim, Ellis alleged that Luxbury owed him a duty, that Luxbury breached that duty, and that the breach resulted in his injuries.
