Appellants-plaintiffs and cross-appellees James and Barbara Hopper (the Hoppers) and TK., the Hoppers' minor granddaughter, appeal the trial court's entry of summary judgment in favor of the appellees-defendants Colonial Motel Properties, Inc., (Colonial Motel), David W. Clary and Jason M. Bird, 1 with respect to their claims for nuisance and breach of contract. Specifically, the Hoppers contend that the existence of genuine issues of material fact preclude summary judgment for Colonial Motel.
