The husband of the plaintiff was killed on the 16th day of April, 1929, while crossing defendant’s tracks on a public highway in the city of Kenosha. This action is brought to recover damages sustained by the plaintiff by reason of such death. There was a special verdict of the jury upon which judgment was rendered in favor of the plaintiff. The appellant assigns numerous errors, among which is that a nonsuit should have been granted or, in lieu thereof, a verdict directed in favor of the defendant because of the contributory negligence of the deceased.
