On October 2, 1951, about eight o’clock in the evening, the plaintiff, Conrad Lang, was struck by the Frisco’s westbound passenger train, the “Meteor,” as he walked across the railroad’s tracks at Fourth and Pacific Streets in Pacific. To recover damages for his resulting personal injuries Mr. Lang instituted this action against the railroad, and he has recovered a judgment, for $18,359.00.
