At about 6:30 p. m. on December 21, 1953, Walter J. Glowacki was a passenger in a station wagon being driven by appellant Louis E. Stagoslci eastwardly on bypass U.S. Highway 40. Appellant Warren Holste was driving his automobile west-wardly and the vehicles collided. The collision occurred about V/2 miles west of St. Peters on a stretch of blacktop pavement which temporarily connected new concrete pavement on the west with old pavement on the east. Glowacki had a verdict for $25,000, and Holste and -Stagoski appealed from the ensuing judgment. Stagoski’s appeal was…
