HENDERSON, Judge.
Appellant was convicted of murder in the first degree, and his punishment assessed at confinement in the penitentiary for life. The indictment charged appellant with the murder of his wife, on December 6, 1904, the allegation as to the cause of the death being the administration of strychnine from a fountain syringe into the rectum. Appellant and his family resided in Joshua (a little town in Johnson County) where appellant had a store.
