RAMSEY, Judge.

The appellant in this case was convicted of the murder of one Oscar Crosby and his punishment assessed at death. The killing is shown to have occurred on the 10th day of December, 1907. The deceased was shot and killed one night about 9:30 o’clock at his house. He w'as called from his room and assassinated. Lula Crosby, the wife of the deceased, was also indicted as a principal in the murder.
