RAMSEY, Judge.

By indictment filed in the District Court of Shelby County on the 17th day of August, 1908, appellant was charged with the murder of one S. A. Eraser. This killing is charged to have been committed on the 15th day of June preceding. At a trial held in said court on the 14th day of September, 1909, appellant was by' the jury found guilty of murder in the second degree and his punishment assessed at confinement in the penitentiary for a period of five years.
