HOUGH, Circuit Judge (after stating the facts as above).
[1] An insurance broker, like other brokers, is primarily the agent of the first person who employs him, and is therefore ordinarily the agent of the insured.
[2] An insurance agent, however, within the scope of his actual .authority, and whether in trade parlance given the description gen*365eral, special, issuing, local, or soliciting, is the agent of the insurer.
