FIRESTONE, Judge.
Pending before the court is the United States’ (the “government’s”) August 26, 2003 motion to dismiss the plaintiffs amended complaint. The plaintiff seeks damages for property that he contends was improperly held by the government and damaged or destroyed during a criminal investigation.
