MEMORANDUM AND ORDER

THIS CAUSE comes before the court on plaintiffs’ motion for summary judgment. Oral argument has been requested but is denied in order to expedite the business of the court. Local Rule 5(C)(1).

This is an action to restrain the Bristol Bay Borough and officials of the Borough from assessing, levying and collecting real and personal property taxes from Alaskan Natives residing on restricted lands held in trust by the United States for the use and benefit of Alaskan Natives in the Village of South Naknek, Alaska.
