OPINION AND ORDER

CEREZO, Chief Judge.

Jesús F. Femández-Fernández, M.D., filed this action for injunctive relief and damages under the Fourteenth Amendment of the U.S. Constitution, and the Civil Rights Act of 1871, as amended, 42 U.S.C.
