OPINION
SAND, District Judge.
Plaintiff Michael Brown brought this action pursuant to 42 U.S.C. §§ 1981, 1983, 1985(3), and 1988 and the first, fourth, fifth, eighth, and fourteenth amendments to the United States Constitution against the Metropolitan Transit Authority, New York City Transit Authority Police Department, and Police Officers Rory McGinn and Peter Brown, alleging violations of his civil rights.
