MEMORANDUM AND ORDER
NICKERSON, District Judge.
Plaintiff brought this action under 42 U.S.C. § 1983, alleging that defendant police officers used excessive force in effecting his arrest on January 26, 1978 for armed robbery.
On April 4, 1979 plaintiff filed a pro se complaint in the Southern District of New York, naming as defendants “Guy Krauss” and “H. McSrunnez”. Because these names were incorrect, the Marshal was unable to serve defendants. On April 27, 1979 Judge Pierre N. Leval determined that, although venue was improper, transfer to the proper district was in the interests of justice.…
