Plaintiffs TCG New York, Inc., TC Systems, Inc. and Teleport Communications d/b/a TCNY (collectively, “TCG” or “Plaintiffs”) commenced this action against the City of White Plains (the “City” or “Defendant”), alleging violations of § 253 of the Telecommunications Act of 1996, 47 U.S.C. § 253 (the “TCA”), the Fourteenth Amendment of the United States Constitution and New York state law.
