OPINION
SMITH, Circuit Judge.
This ease returns to us for resolution of the “important questions about the scope of the political question doctrine and the Federal Tort Claims Act’s ‘combatant activities’ exception” in suits against defense contractors. We did not have the opportunity to reach these issues when this case was before us previously. Harris v. Kellogg, Brown & Root Servs., Inc., 618 F.3d 398, 399 (3d Cir.2010).
