CLARK, Circuit Judge.
This action was brought against the defendant, as trustee of the Chicago and North Western Railway Company, to recover damages for the wrongful death of plaintiff’s intestate, Private Victor Jacobo-' witz, a member of the military police of the United States Army, who was struck and killed by one of defendant’s trains while on duty guarding a railroad bridge across the Mississippi River between Illinois and Iowa.
