ORDER
DOTY, District Judge.
This matter is before the court on the motion of plaintiff Michael Barnes to strike the affidavit of Kathleen Jackson and the motion of defendant The Benham Group, Inc., for summary judgment and for sanctions. Based on a review of the file, record, and proceedings herein, the court denies plaintiffs motion to strike, grants defendant’s motion for summary judgment, and denies defendant’s motion for sanctions.
