I. INTRODUCTION

This contract case addresses the basic principle of always ensuring that jurisdiction exists. Before the court is the defendant’s motion to dismiss for lack of subject-matter jurisdiction pursuant to Federal Rule of Civil Procedure 12(b)(1). The complaint invokes this court’s jurisdiction under 28 U.S.C. § 1332(a), the diversity statute.
