The plaintiffs, Ryan and Cathy Fandrich, filed a second amended complaint in the District Court for the First Judicial District in Lewis and Clark County in which they alleged that they were wrongfully discharged from their employment, and that Cathy had been sexually harassed and assaulted, and that her basic personal rights had been violated. The District Court dismissed the second amended complaint, based on its conclusion that the Montana Human Rights Act provided the Fandrichs’ exclusive remedy.
