The plaintiff, Westinghouse Electric Corporation, brought an action in the District Court for the District of New Jersey seeking a declaratory judgment that in the manufacture and sale of its ultra violet high pressure mercury vapor lamps it had not infringed the Germer Patent No. 2,202,199 owned by General Electric Company under which the defendant, Han-ovia Chemical and Manufacturing Company, has' exclusive rights in the field of ultra violet high pressure mercury vapor lamps.
