MEANEY, District Judge.

The plaintiff, Westinghouse Electric Corporation, brings this action, asking for a declaratory judgment under the provisions, of 28 U.S.C.A. § 400. The complaint sets forth that the plaintiff is engaged, among other activities, in the manufacture and sale of ultra-violet high pressure mercury vapor lamps, which have met with a large and increasing measure of success with the trade and the purchasing public; that the defendant has, under instruments in writing, the exclusive right to make, use and sell, including the right to license and sue others, in the field of…
