This action was commenced by Barry Engler (“Engler” or the “Plaintiff’) against his former employers, Cendant Corporation (“Cendant”) and International Business Machines Corporation (“IBM”) (collectively the “Defendants”) to recover severance and medical benefits allegedly owed to him under an employee benefit plan.
