Maria De Lourdes Parra Marin complains against her former employer, Dave & Busters (“D & B”), for acts of discrimination in violation of section 510 of ERISA, 29 USC section 1140. Plaintiff worked full-time, 30 to 45 hours per week, at the D & B Times Square location from 2006 to 2013 and received health insurance under the D & B health insurance plan, an “employee welfare benefit plan” under ERISA, 29 U.S.C. § 1002.
