On November 17, 1950, an accident occurred upon a public highway in Sacramento County involving a truck and trailer, then owned and operated by Vincent Graffio, and a passenger car driven by respondent Dorothy Skelton, wife of respondent John W. Skelton. Action was filed by respondents against appellant Graffio and also against appellant Agnes Fekete doing business under the name of Segundo Trucking Company.
