On October 24,1999, Juan Tavares, while operating an automobile insured by the defendant, Arnica Mutual Insurance Co. (“Arnica”), was involved in an automobile accident Tavares’ policy was a standard Massachusetts automobile policy and provided him with Personal Injury Protection (“PIP”).
