The plaintiff, Dr. Frank E. Salafia (“Salafia”), a chiropractor, has appealed the allowance of summary judgment in favor of the defendant, Horace Mann Insurance Company (“Horace Mann”). Salafia alleged that Horace Mann failed to pay personal injury protection (“PIP”) benefits for treatment he provided to Benjamin Fernandez (“Fernandez”), the operator of a motor vehicle owned by Horace Mann’s insured, in violation of G.L.c. 90, §34M.
