OPINION

BRUGGINK, Judge.

This is an action by a civilian Marine Corps employee seeking the payment of a living quarters allowance (“LQA”) as provided by 5 U.S.C. § 5923 (2006). Although the Marine Corps neither offered nor advertised the payment of LQA for this particular job posting, plaintiff contends that he is owed the allowance as a matter of law. Currently before the court are defendant’s motion for summary judgment and partial dismissal and motion in limine to strike certain declarations.
