This action originated in the justice of the peace court in Pittsburg county, being one of forcible entry and detainer brought by Milby & Dow Goal & Mining-Company, as plaintiff, to recover from defendant, Charles Hughes, as is described in plaintiff’s complaint, “* * * possession of the following described premises, to wit; Milioy & Dow Coal & Mining Company, House No. 145 in the town of Dow (Dow Camp) Pitts-burg county, state of Oklahoma.”

Parties herein will be referred to as they appeared in the lower court.
