Tbis was an action of ejectment on tbe demises of Lowe and Small, tbe real defendant to wbicb was Mrs. Pottle, wbo was in tbe actual possession of tbe premises. It appears from tbe record, that sbe and ber mother, Mrs. Hamilton, wbo bas since died, borrowed money from tbe Georgia Loan and Trust Company and gave notes for tbe same, secured by a deed, executed under section 1969 et seq. of tbe code, conveying to tbe lender tbe land in dispute. This deed contained -a power of sale authorizing tbe loan com*577pany to sell tbe land in case of any default in paying tbe. interest…
