Respondent Jasper B. Varn, Jr. (Varn) commenced this action for personal injuries against Appellant the South Carolina Department of Highways and Public Transportation (Department) alleging negligence by the Department while removing a tree from a roadway. The circuit court referred *351the case with finality to a special referee. The special referee awarded damages to Varn. The Department appeals. We affirm.
