This is an accelerated appeal of an interlocutory order pursuant to section 51.014(d) of the Texas Civil Practice and Remedies Code. Tex. Civ. PRAC. & Rem.Code Ann. § 51.014(d) (Vernon 2003) (allowing for interlocutory appeal when parties agree that order involves controlling question of law with substantial ground for difference of opinion).
