Plaintiffs Carl Price and his wife brought suit against Defendant Kitsap Transit for injuries Mr. Price sustained while he was a passenger on a bus owned by Kitsap Transit. The trial court assigned fault for Mr. Price’s injuries to three parties as follows: 10 percent to Kitsap Transit; 80 percent to a 4-year-old passenger; and 10 percent to the father of the 4-year-old passenger. Holding the trial court improperly assigned fault to a 4-year-old child, the Court of *459Appeals reversed the trial court decision and remanded to the trial court for reapportionment of fault.
