GILL, Associate Justice.
This was an action of trespass to try title brought by L. B. Moody against Charles F. Bogart for the recovery of certain lands in Harris County. A trial before the court without a jury resulted in a judgment for Moody and Bogart has appealed.
The plaintiff deraigned title through and under Daniel D. Culp, assignee and patentee as follows:
