In the year 1848 William Richey and his then wife, Sarah A. Richey, now Wimberly, and who was plaintiff below, immigrated into Mercer’s colony, and remained there a sufficient length of time to have entitled them, under statutes . subsequently passed, to a certificate for six hundred and forty acres of land. On September 21, 1851, they were divorced by decree of the district court of Hunt county.
