This is an appeal from an order granting a new trial.

September 18, 1940, an Intermountáin Transportation Company bus on a run from Butte to Great Falls on Highway No. 91, with Morris Hoyle driving, stopped about a mile before reaching the town of Cascade for the purpose of investigating a car in the ditch at the side of the highway and to render such assistance as might be needed.
