HUITINK, Judge.
Nepstad Custom Homes Company brought this mechanic’s lien foreclosure action against Curtis and Chris Krull for amounts due for the construction of a home. First Interstate Bank provided the financing and now holds a mortgage on the home. The defendants counterclaimed for fraudulent misrepresentation and breach of contract, eventually dismissing the misrepresentation claim. The matter proceeded to a bench trial.
