This is an appeal from a judgment in favor of the relators in an action filed by them against the Board of Trustees of the Town of Thorntown, wherein the respondents were mandated to prepare and file a list or roll of all owners of property affected by the vacation of parts of certain streets.

The complaint alleges that the relators are the respective owners of the several tracts of land abutting the streets described; that the Board of Trustees of the Town of Thorntown on September 3, 1929, adopted a declaratory resolution providing for such vacation; that upon the adoption of the resolution…
