Appeal by the relator, James-Benedict, from an order of the Supreme Court, made at the Westchester Special Term and entered in the office of the clerk of the county of Westchester on the 31st day of July, 189Y, dismissing and quashing a writ of certiorari and also from the judgment entered upon said order.

Goodrich, P. J.:
The relator, James Benedict, presented to the court below on June 15, 1897, a.petition for a writ of certiorari directed to the defendants Roe, Odell and Merritt, claiming to act as assessors of the village of Tarrytown, to certify and return to the court 'the assessment roll of the village for the current year. A writ was granted and the defendants were, ordered to certify, among other things, all proceedings concerning the laying of the several assessments upon the real estate of the relator in said village.
