Respondents move to quash the writ upon the grounds that the relator failed to apply to the board of assessment review and to the city council to correct its assessment, and that the petition insufficiently alleges the filing of objections with the city *794assessor. Whether application to the board of assessment review and the city council is in each instance a condition precedent to the issuance of the writ involves the application of section 290 of the Tax Law which provides that the petition must show “ that the application has been made in due time to…
