OPINION

MURRAY, Justice.

This is a Superior Court civil action in which the plaintiffs have appealed from a judgment granting the defendants’ motion to dismiss their complaint pursuant to Rule 41(b)(2) of the Superior Court Rules of Civil Procedure. 1

The plaintiffs, Irwin and Joan Anderson, own a parcel of land situated in the town of East Greenwich. They filed a complaint in Superior Court on August 24,1981, in which they requested an injunction prohibiting the town from widening and improving a roadway known as Bates Trail which abuts the Anderson property on its northern edge. 2 The…
